Probate & Guardianship

Probate involves the process of ensuring that a deceased person’s wishes are fulfilled, either through the faithful execution of a will or the intestacy laws.  We have experience representing personal representatives, as well as heirs who may contest a will on the basis of undue influence or lack of testamentary capacity.  Either way, the goal is to ensure that the true wishes of the deceased are executed. 

Guardianships involve the appointment of a guardian who is delegated the obligation to handle the affairs of a person who is declared incapacitated or unable to make decisions for himself/herself (the “ward”).  The guardian is subject to a court’s oversight.  Our attorneys have experience in representing the guardian to advice and counsel the guardian in the affairs of the ward.
